China Leaves America In The Past

The Beijing Internet Court decided to recognize the copyright of an image generated via artificial intelligence, marking a significant step forward for the burgeoning field of generative AI.

The court ruled this past November that an image created using Stable Diffusion, a text-to-image software, should be legally considered an artwork.

This ruling stems from the case involving an image of a young Asian woman, which was at the heart of an intellectual property dispute.

The presiding judge, Zhu Ge, emphasized that this decision aims to encourage creativity using AI tools, asserting that excluding AI-generated content from being considered as artwork could hinder the industry’s growth.

Zhu’s stance is that such content, when it reflects the “originality” and intellectual input of a human creator, merits legal protection.

The controversy began when a plaintiff, using the name Li, created the disputed image and posted it on Xiaohongshu, a Chinese social media platform.

Li sued a blogger for using the image without permission, leading to the court ruling in Li’s favor. The defendant was ordered to apologize publicly and pay damages.

Meanwhile, in America, Kris Kastanova had her book “Zarya of the Dawn“ stripped of its’ copyright status with the USCO claiming that only human authors can claim copyright protection for their works.

The USCO found that Kashtanova did not exercise sufficient creative control over the output of Midjourney and that there was too much “distance” between the user’s input and the AI’s output.

This ruling in China not only fuels the debate over AI-generated content’s copyright status but also sets a precedent for future cases.

It’s seen as a step aligning with China’s growing aspirations in the generative AI sector, expected to significantly contribute to the economy by 2035.

OpenAI’s Plan For Election Misinformation

As detailed on OpenAI’s blog, new rules prohibit the use of OpenAI tools, including ChatGPT and Dall-e, for impersonating candidates, local governments, and engaging in campaign or lobbying activities.

The measures also forbid the use of these tools to discourage voting or misrepresent the voting process.

In a proactive move against misinformation, OpenAI plans to implement the Coalition for Content Provenance and Authenticity’s (C2PA) digital credentials into images generated by Dall-E.

This system will encode images with their origin, making it easier to identify AI-generated images. Major tech companies like Microsoft, Amazon, Adobe, and Getty are collaborating with C2PA in this initiative.

Moreover, OpenAI’s tools will direct U.S. voting queries to CanIVote.org, a reliable source for voting information. However, these tools and policies are still in the rollout phase and rely significantly on user reporting to identify misuse.

For now, the emphasis is on promoting media literacy, encouraging the public to critically assess and verify news and images, especially those that appear too sensational or implausible.
